SGE Portal - Terms of Use

StarGuard ELITE (“SGE”) provides access to the SGE Lifeguard Portal (“Portal”) subject to the following Terms of Use. By accessing or using the Portal, you agree to these Terms. If you do not agree, do not use the Portal.
Ownership of the Portal
The Portal and all associated sites linked to www.starguardelite.com are owned or licensed by SGE. All text, graphics, interfaces, photographs, trademarks, logos, sounds, music, artwork, and computer code (“Content”) are protected by intellectual property laws.
Except as expressly permitted, no Content may be copied, reproduced, republished, uploaded, posted, publicly displayed, encoded, translated, transmitted, or distributed without SGE’s prior written consent.
You may use information purposely made available for download if you:
- Do not remove proprietary notices
- Use the information only for its intended purpose
- Do not modify it
- Do not make additional representations or warranties
Your Use of the Portal
You may not:
- Use automated tools (robots, scrapers, spiders) to access or copy the Portal
- Attempt unauthorized access to any part of the Portal
- Probe, scan, or test system vulnerabilities
- Interfere with Portal operations or other users’ experience
- Impersonate another person or misrepresent your identity
- Use the Portal for unlawful purposes or to infringe the rights of others
You agree not to impose unreasonable load on the Portal infrastructure or disrupt its operation.
AI‑Assisted Processing
SGE uses AI‑assisted tools to support:
- Fraud detection
- Identity verification
- Security monitoring
- Analytics and operational insights
AI does not independently make decisions that affect your rights, account access, certifications, or employment status. All meaningful decisions involve human review. SGE evaluates AI tools for fairness, accuracy, and relevance and does not use AI for profiling that produces legal or similarly significant effects.
Purchases and Additional Terms
Additional terms may apply to purchases, online courses, promotions, or specific features. If those terms conflict with these Terms of Use, the specific terms control for that feature.
SGE may change products, services, or pricing at any time without notice.
Accounts, Passwords, and Security
Some Portal features require an account. You are responsible for maintaining the confidentiality of your credentials and for all activity under your account.
You agree to notify SGE immediately of unauthorized use or security breaches. You may not use another person’s account without permission. SGE is not liable for losses resulting from your failure to secure your account.
Privacy and Consent Practices
SGE’s Privacy Policy governs use of the Portal and is incorporated by reference.
You acknowledge that Internet transmissions may be intercepted despite encryption.
SGE does not use manipulative or deceptive design practices (“dark patterns”) to obtain consent. All material terms are presented clearly, and you may withdraw consent where applicable.
Accessibility
SGE is committed to providing an accessible Portal experience and strives to align with WCAG 2.2 AA standards. Users with disabilities may request accommodations through the contact information provided in these Terms.
Links to Third‑Party Sites
The Portal may contain links to independent third‑party websites. SGE is not responsible for their content and does not endorse them. You access Linked Sites at your own discretion.
User‑Generated Content
If the Portal allows you to upload or submit content, you grant SGE a non‑exclusive, worldwide license to use, store, reproduce, and display that content solely for Portal operations.
You may not upload content that:
- Violates laws or third‑party rights
- Contains malware or harmful code
- Is abusive, discriminatory, or inappropriate
- Interferes with Portal operations
SGE may remove content or suspend accounts that violate these rules.
Disclaimers
The Portal and its Content are provided “as is” and “as available.” SGE does not guarantee uninterrupted or error‑free operation. SGE disclaims all warranties, including accuracy, non‑infringement, merchantability, and fitness for a particular purpose.
You assume full responsibility for your use of the Portal.
Limitation of Liability
Except where prohibited by law, SGE is not liable for indirect, consequential, incidental, or punitive damages. If SGE is found liable, its total liability will not exceed the subscription or similar fees paid in the six months preceding the claim.
This limitation does not apply to intentional misconduct.
Indemnity
You agree to indemnify SGE and its affiliates from claims arising out of your use of the Portal or violation of these Terms.
Violation of These Terms
SGE may disclose information about you if necessary to comply with law or protect SGE’s rights. SGE may terminate your access without notice if you violate these Terms.
Governing Law and Dispute Resolution
These Terms are governed by U.S. and Florida law. Disputes will be resolved in the state or federal courts of Orange County, Florida, unless you are an EU consumer, in which case you may bring claims in your home country.
Claims must be brought within one year unless prohibited by law.
Parties will attempt good‑faith resolution, then mediation, before pursuing litigation.
Cross‑Border Data Transfers
SGE may transfer personal information internationally. When doing so, SGE uses legally recognized safeguards such as Standard Contractual Clauses or adequacy decisions to ensure consistent protection.
Data Protection and Security
SGE maintains administrative, technical, and physical safeguards to protect Protected Data, including encryption, access controls, and monitoring systems.
Authorized Persons accessing Protected Data are bound by confidentiality obligations.
Security Breach Notification
SGE will notify you without undue delay and within the timeframe required by applicable law if it becomes aware of:
- Unauthorized access to Protected Data
- Loss, alteration, or disclosure of Protected Data
- Circumstances preventing compliance with data‑protection laws
Child Privacy
Children under 13 (or local minimum age) may not create Portal accounts without verifiable parental consent. Parents may request access, correction, or deletion of a child’s data.
Compliance Verification
Upon written request, SGE will provide information necessary to verify compliance with applicable data‑protection laws, including completing security questionnaires.
Void Where Prohibited
SGE administers the Portal from Florida, USA. Not all features are available in all locations. You are responsible for complying with local laws when accessing the Portal outside the United States.
Miscellaneous
If any provision is unenforceable, it will be replaced with a valid provision that reflects the original intent. These Terms constitute the entire agreement regarding Portal use.
Feedback submitted through the Portal is considered non‑confidential.
